Scope of Application

  1. These General Terms and Conditions (GTC) of Careercomforts (hereinafter referred to as "Seller") apply to all contracts for the delivery of goods concluded between the Seller and consumers or entrepreneurs (hereinafter referred to as "Customers") via the Seller's online shop. The inclusion of the Customer’s own terms and conditions is hereby rejected unless otherwise agreed in writing.

  2. These GTC also apply accordingly to contracts for the delivery of vouchers, unless otherwise stipulated.

  3. A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.

  4. An entrepreneur within the meaning of these GTC is a natural or legal person or a legal partnership acting in the course of their commercial or self-employed professional activity when concluding a legal transaction.

Conclusion of Contract

The products displayed in the Seller's online shop do not constitute a binding offer but serve as an invitation for the Customer to submit a binding offer.

The Customer can submit their offer via the order form provided in the online shop. By completing the order process and clicking the final order button, the Customer submits a legally binding declaration for the items in the shopping cart.

The Seller may accept the offer within five days in the following ways:

  • By sending a written order confirmation or an order confirmation via email, where receipt by the Customer is decisive.

  • By delivering the ordered goods, where receipt of the goods by the Customer is decisive.

  • By requesting payment from the Customer.

If the Seller does not accept the offer within the specified period, the offer is considered rejected, and the Customer is no longer bound by their order.

If the Customer selects a PayPal payment method, the contract is concluded upon completion of the payment transaction. The same applies to Amazon Payments.

The contract text is stored by the Seller after the order is completed and sent to the Customer via email. The Seller does not store it beyond this.

The contract language is the respective language in which the website is displayed.

Right of Withdrawal

Consumers have a statutory right of withdrawal.

Details regarding the right of withdrawal can be found in the Seller’s withdrawal policy.

Prices and Payment Terms

  1. All stated prices include the statutory value-added tax. Any applicable shipping costs are stated separately.

  2. The payment methods offered in the online shop are available to the Customer.

  3. For advance payment, the payment is due immediately after the conclusion of the contract.

  4. The Seller offers several payment options, including but not limited to PayPal, SOFORT, Stripe, credit card, and bank transfer. The respective terms and conditions of these payment providers apply.

Delivery and Shipping Conditions

  1. Delivery is made within the specified delivery area to the address provided by the Customer.

  2. If delivery fails due to reasons attributable to the Customer, the Customer bears the resulting costs.

  3. For entrepreneurs, the risk of loss or damage to the goods passes to the Customer as soon as the goods are handed over to the shipping service provider. For consumers, this only applies upon actual receipt of the goods.

  4. If the goods are unavailable, the Customer will be informed immediately, and any payment already made will be refunded.

Retention of Title

The Seller retains ownership of the delivered goods until full payment has been made.

Liability for Defects (Warranty)

  1. The statutory provisions on liability for defects apply.

  2. In contracts between entrepreneurs, the limitation period for defect claims is one year.

Special Conditions for Processing Goods According to Customer Specifications

  1. The Customer is responsible for the content they provide and guarantees that no third-party rights are violated.

  2. The Seller reserves the right to reject processing orders that violate legal regulations or public decency.

Redemption of Promotional Vouchers

  1. Promotional vouchers can only be redeemed within the specified period and exclusively in the online shop.

  2. Cash payment is excluded.

  3. Only one promotional voucher can be used per order.

Redemption of Gift Vouchers

  1. Gift vouchers can only be redeemed before completing the order process.

  2. Cash payment is not possible.

Applicable Law

The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

Alternative Dispute Resolution

The Seller is neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
